1. Introduction

Welcome to SmartChurch. These Terms of Service (“Terms”) govern your access to and use of the SmartChurch website, software application, and related services.

SmartChurch is a church management platform designed to help churches and religious organisations manage members, finances, attendance, communications, branches, follow-ups, and other administrative activities.

In these Terms, “SmartChurch,” “we,” “our,” or “us” refers to the operator of the SmartChurch platform. “You” or “your” refers to the individual, church, organisation, or authorised representative accessing or using our services.

By creating an account, subscribing to a plan, or using SmartChurch, you agree to these Terms. If you do not agree, you should discontinue your use of the platform.

2. Eligibility and Account Registration

To use SmartChurch, you must have the legal capacity to enter into a binding agreement. If you register on behalf of a church or organisation, you confirm that you are authorised to accept these Terms on its behalf.

You agree to:

  • Provide accurate and complete registration information.

  • Keep your account information current.

  • Maintain the confidentiality of your login credentials.

  • Restrict access to your account to authorised individuals.

  • Notify us promptly if you suspect unauthorised access or a security breach.

You are responsible for activities carried out through your account, except where applicable law provides otherwise or the activity results from our failure to meet our legal obligations.

We reserve the right to restrict or suspend accounts where registration information is materially false, fraudulent, or used in violation of these Terms.

3. Services Provided

SmartChurch provides digital tools to support church administration and operations. Depending on your subscription and the features available, these services may include:

  • Church member registration and management.

  • Attendance tracking and service reports.

  • Financial records, budgets, and reporting.

  • Branch and church network management.

  • Member follow-ups and automated workflows.

  • Digital forms and self-registration.

  • SMS and email communication tools.

  • Other administrative and reporting features introduced from time to time.

We may update, improve, add, or discontinue features as the platform evolves. Where a change materially affects your use of the service, we will make reasonable efforts to provide appropriate notice, subject to applicable law and any contractual commitments.

4. Free Trials and Subscriptions

SmartChurch may offer a free trial or other promotional access to eligible users. The duration and conditions of any trial will be communicated when the offer is presented.

Unless otherwise stated, a free trial provides access to the applicable platform features for the stated trial period. We may require a paid subscription to continue using the service after the trial expires.

We may update, improve, add, or discontinue features as the platform evolves. Where a change materially affects your use of the service, we will make reasonable efforts to provide appropriate notice, subject to applicable law and any contractual commitments.

Subscription Plans

SmartChurch may offer monthly and annual subscription plans. Current pricing and plan details are displayed on our website or within the application.

Subscriptions are subject to the following conditions:

  • Monthly subscription: The applicable fee is charged for each monthly subscription period.
  • Annual subscription: The applicable annual fee is charged for the annual subscription period.
  • Promotional pricing: Discounts and special offers apply only under the conditions communicated with the relevant offer.
  • Feature access: Subscription fees cover access to the features included in the selected plan, subject to any stated limitations.

Your subscription does not automatically include unlimited SMS messages, email sending, or other services that are separately charged based on usage.

5. Acceptable Use

You agree not to use SmartChurch for unlawful activities, fraud, spam, harassment, unauthorised access, or any activity that compromises the security or operation of the platform.

You must ensure that you have the appropriate authority or lawful basis to upload personal information and communicate with individuals through SmartChurch.

We may restrict access where necessary to address violations, security risks, or legal requirements.

6. Data and Privacy

You retain ownership of the information you upload to SmartChurch. You are responsible for ensuring that you have the right to collect and use that information.

We process information as necessary to provide and maintain the platform, manage accounts and payments, support users, and protect our services.

7. Service Availability and Intellectual Property

SmartChurch aims to provide reliable service but does not guarantee uninterrupted access. Temporary interruptions may occur due to maintenance, technical issues, or third-party service disruptions.

The platform, software, branding, and associated materials remain the property of their respective owners. You may use SmartChurch for its intended purposes but may not copy, resell, or exploit the platform without permission, except where permitted by law.

8. Suspension and Termination

We may suspend or terminate access if you materially violate these Terms, engage in fraudulent or unlawful activities, create security risks, or fail to pay required charges after appropriate notice where applicable.

You may stop using SmartChurch and cancel your subscription in accordance with these Terms.

You should export important records before ending your subscription where export functionality is available. Data retention and deletion are subject to our Privacy Policy and applicable law.

9. Liability

SmartChurch will take reasonable steps to maintain the security and reliability of its services. However, to the extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the platform.

Churches remain responsible for verifying their financial records, maintaining appropriate internal controls, and ensuring that their use of SmartChurch complies with applicable laws.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

10. Governing Law and Contact

These Terms are governed by the laws of the Federal Republic of Nigeria, subject to any mandatory applicable law.
